Rachel Maddow took some time the other day to analyze the federal court cases around the nation that, at “lightning speed,” are doing away with the various same-sex marriage bans around the country. Speaking with Kenji Yoshino, a constitutional law professor at NYU, they discussed the recent rulings that have completely done away with bans in Utah, Oklahoma and Virginia, and the decision in Kentucky which requires the state to recognize out of state marriages. Adding to the tide of equality, Nevada’s attorney general and governor have announced that they no longer will defend their state’s marriage ban. Yoshino goes a bit deeper, explaining that, after Windsor last year, it was sort of left up in the air whether that was a states’ rights or a gay rights case, and that the lower courts have decided that it was a gay rights case.
