Today, the Supreme Court upheld a federal appellate court ruling that affirmed the constitutionality of university nondiscrimination policies. San Diego State University’s policy prohibits officially recognized campus groups from discriminating on the basis of sexual orientation or religious beliefs. The university chapter of Alpha Delta Chi, a “Christian” sorority and fraternity, sued, saying the policy violated the group’s religious freedom to bar LGBT people from membership. A federal appeals court rejected that argument, and the Supreme Court refused to hear an appeal, leaving the lower court ruling in place.
This is an important blow to the special right sought by socially conservative religious groups receiving public funds to discriminate against LGBT people in the public square.
